BioSonics Privacy Policy

This Privacy Policy explains how BioSonic Enterprises, Inc. (“BioSonics,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit our website, shop, create an account, contact support, download content, attend an online program, apply for a wholesale or affiliate program, or use another BioSonics service (collectively, the “Services”).

This policy does not apply to independently operated third-party websites or services. If a product, program, or relationship has a separate privacy notice, that notice also applies and controls to the extent it specifically addresses the processing involved.

1. Scope and responsibility

BioSonics is responsible for the personal information covered by this policy. “Personal information” means information that identifies, relates to, describes, or can reasonably be linked with an individual or household. It does not include information that has been aggregated or deidentified so it cannot reasonably identify you.

2. Information we collect

The information involved depends on how you use the Services.

Please do not send sensitive medical information, government identifiers, full payment-card details, or other information that is not needed for your request.

3. Sources of information

We collect information directly from you; automatically from browsers, devices, cookies, server logs, and security tools; and from service providers involved in payments, fraud prevention, delivery, analytics, communications, account authentication, and customer support. We may also receive information from an organization, instructor, affiliate, or business partner when you ask it to interact with BioSonics or when needed to administer an authorized program.

4. How we use information

We use personal information to:

  • operate, personalize, maintain, and secure the Services;
  • process orders, payments, shipping, downloads, returns, gift cards, and customer requests;
  • create accounts and administer retail, wholesale, teacher, practitioner, course, and affiliate access;
  • provide customer service, interactive tools, product guidance, and requested communications;
  • detect fraud, abuse, technical problems, and security incidents;
  • measure and improve performance, content, products, and customer experience;
  • maintain business, tax, accounting, warranty, consent, and legal records;
  • send marketing where permitted and consistent with your choices; and
  • comply with law, enforce agreements, and protect rights, safety, and property.

Where applicable law requires a legal basis, processing may rely on performance of a contract, legitimate interests, legal obligations, protection of vital interests, or consent. You may withdraw consent at any time, without affecting earlier lawful processing.

5. Payments and checkout

Payment-card and other payment information is submitted to the payment provider selected at checkout. BioSonics may receive transaction identifiers, payment status, limited card details such as brand and last digits, billing information, and fraud-screening results, but should not receive or store the complete card number unless a configured provider expressly requires and documents that processing. Payment providers handle information under their own terms and privacy notices.

6. Cookies and similar technologies

Cookies, pixels, local storage, and related technologies may support the cart, checkout, accounts, security, saved preferences, optional media, analytics, attribution, and advertising. Necessary technologies operate because the website cannot function reliably without them. Optional functional, analytics, and marketing categories are controlled through the site’s Cookie Preferences center and remain disabled until selected where consent is required.

Managing cookie choices

Use the Cookie Preferences control available in the site footer to accept, reject, customize, or later withdraw optional consent. Browser settings can also block or delete cookies, but doing so may affect cart, login, checkout, media, or other functions. Where legally required, BioSonics honors a recognized Global Privacy Control signal as an opt-out of sale or sharing for the browser or profile sending the signal.

7. Optional voice and AI-assisted features

Interactive concierge, character, chat, or voice features operate only when you choose to use them. Microphone access requires browser or device permission. Your typed or spoken input, the generated response, and limited technical logs may be processed by BioSonics and configured technology providers to deliver, secure, and troubleshoot the feature. A saved default audio-input preference may be stored locally in your browser so it can be remembered without requiring a new selection each visit. Do not use these features to submit confidential medical, financial, or legal information. Automated responses can be incomplete or inaccurate and should not be treated as professional advice.

8. How information is disclosed

We may disclose personal information as reasonably necessary to:

  • service providers supporting hosting, security, payments, fraud prevention, shipping, email, customer support, analytics, media, and website functions;
  • instructors, affiliates, or program partners when needed for a service or program you request and subject to applicable agreements;
  • professional advisers such as accountants, auditors, insurers, and legal advisers;
  • government authorities or other parties when required by law or reasonably necessary to protect customers, rights, safety, property, or the Services; and
  • a successor organization in connection with a merger, financing, reorganization, sale, or transfer of all or part of the business, subject to appropriate safeguards.

We may also disclose information at your direction or with your consent. Service providers are expected to use personal information only for contracted services and applicable legal obligations.

9. Sale, sharing, and targeted advertising

BioSonics does not sell personal information for money. Some privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include disclosures to advertising or analytics partners for cross-context behavioral advertising. BioSonics limits optional marketing technologies according to the choices recorded in the Cookie Preferences center and applicable Global Privacy Control signals. Where required, you may opt out without creating an account and without discriminatory treatment. BioSonics does not knowingly sell or share personal information of people under 16.

10. Retention, backups, and archived orders

We retain information only as long as reasonably needed for the purposes described in this policy, including fulfillment, account access, support, warranties, tax and accounting requirements, fraud prevention, security, disputes, and legal obligations. Retention periods vary by record type and applicable law.

Older orders may be moved from the active store database to a protected archive to improve site performance. Archiving does not by itself eliminate required business records. If an archived order is no longer visible in your account, you may request a copy or restoration review through customer support. Requests are verified before archived information is returned. Backup copies are retained according to backup schedules and are isolated from ordinary use until overwritten or needed for recovery.

When information is no longer required, we take reasonable steps to delete, deidentify, or securely isolate it, subject to technical and legal limitations.

11. Security

BioSonics uses administrative, technical, and physical safeguards appropriate to the nature of the information, including transport encryption, access controls, software maintenance, backups, monitoring, least-privilege practices, and service-provider review. No internet transmission or storage system can be guaranteed completely secure. Protect your password, sign out of shared devices, and contact us promptly if you suspect unauthorized account activity.

12. Your privacy choices and rights

Depending on where you live, you may have the right to request access to or a copy of personal information; correction; deletion; restriction; portability; withdrawal of consent; or an explanation of processing. You may also have rights to opt out of sale, sharing, targeted advertising, or certain profiling; limit certain uses of sensitive information; appeal a denied request; and receive equal service and pricing without unlawful discrimination for exercising a privacy right.

Submit a request through the contact page or email cservice@biosonics.com. Describe the request and the email address associated with your account or order. We may verify your identity and authority before responding. An authorized agent may submit a request where permitted, but we may require proof of authorization and direct verification. Some information may be retained or excluded where an exception applies, such as completing a transaction, maintaining security, preventing fraud, or satisfying legal obligations.

13. Regional privacy notices

United States state privacy laws

Residents of states with comprehensive privacy laws may exercise the rights available under those laws. The categories collected, sources, purposes, recipients, and retention approach are described throughout this policy. BioSonics will process valid opt-out preference signals where required and provide an appeal method if applicable.

European Economic Area, United Kingdom, and Switzerland

Where applicable, you may have rights of access, rectification, erasure, restriction, objection, and portability, and the right to complain to your local data-protection authority. When processing relies on legitimate interests, those interests include operating and securing the Services, fulfilling customer expectations, preventing fraud, and improving the business, balanced against your rights.

These regional notices apply only when the relevant law covers BioSonics and the processing involved; they do not create rights that a law does not provide.

14. Children

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from a child under 13 without legally required parental consent. If you believe a child has submitted personal information, contact us so we can investigate and take appropriate action. Purchases by minors must be completed with the involvement of a parent or legal guardian.

15. International processing

BioSonics and its service providers may process information in the United States and other countries whose privacy laws differ from those where you live. Where required, we use recognized transfer mechanisms or other safeguards and provide information about them upon valid request.

16. Communications and preferences

Transactional messages concerning orders, accounts, security, downloads, policies, and customer service are sent as needed to provide the Services. Marketing email or text messages are sent only as permitted. You can unsubscribe using the link or instructions in the message. Opting out of marketing does not stop necessary nonmarketing communications.

17. Changes to this policy

We may update this policy when services, vendors, practices, or laws change. The “Last updated” date identifies the current version. Material changes will receive notice when required. Unless otherwise stated, an updated policy applies prospectively from its effective date.

Customer accounts, communications, and purchase updates

Registered customers can use the Privacy Center in My Account to review communication preferences and request access, correction, deactivation, or deletion. Identity verification and administrator review help prevent unauthorized account changes.

Optional purchase notifications are created only when a customer selects the checkout consent box. They use a first name, last initial, and city or country, appear after a delay, and expire automatically. Order identifiers, payment details, email addresses, and street addresses are not published.

Account deletion and personal-data erasure remain subject to financial, tax, fraud-prevention, fulfillment, warranty, dispute, and other legal retention obligations. Records that must be retained may be restricted or anonymized instead of deleted immediately.
