Website and Store Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of the BioSonics website, online store, accounts, content, products, downloads, classes, and related services (collectively, the “Services”). The Services are operated by BioSonic Enterprises, Inc. (“BioSonics,” “we,” “us,” or “our”).

By accessing the Services, creating an account, or placing an order, you agree to these Terms and the policies linked from them. If you do not agree, do not use the Services. Product-specific terms, course terms, wholesale terms, affiliate terms, or another written agreement may also apply; if there is a conflict, the more specific terms control for that product, program, or transaction.

1. Acceptance and eligibility

You must be at least 18 years old, or the age of legal majority where you live, to create an account or purchase through the Services. If you use the Services for a business or organization, you represent that you are authorized to bind it to these Terms. You agree to provide accurate, current information and to use the Services only in compliance with applicable law.

2. Wellness and medical disclaimer

BioSonics products, educational materials, audio content, frequency information, classes, and statements are offered for general educational, personal-development, and wellness purposes. They are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease or health condition. Results and experiences vary. Do not delay or replace professional medical care because of information provided through the Services. Consult an appropriately qualified healthcare professional before changing a health regimen or using a product if you have a medical condition, are pregnant, use an implanted device, take medication, or have safety concerns. In an emergency, contact local emergency services.

3. Products, descriptions, and availability

We work to present accurate product descriptions, photographs, specifications, colors, dimensions, and availability. Natural materials, handcrafted items, crystals, finishes, screens, and manufacturing batches may vary. Images may be illustrative and are not always to scale. We may correct errors, update information, limit quantities, change or discontinue products, or cancel an affected order. If we cancel a paid order, we will refund the amount charged for the canceled item.

4. Orders, pricing, taxes, and payment

Your order is an offer to purchase. An automated receipt confirms that we received the order; acceptance occurs when we approve and fulfill it or otherwise expressly confirm acceptance. We may refuse, limit, or cancel an order for reasons including availability, suspected fraud, pricing or description errors, payment problems, resale concerns, legal restrictions, or misuse of promotions. Prices are displayed in the currency shown at checkout and may change before an order is placed. You are responsible for applicable taxes, shipping, and other charges disclosed at checkout. Payment is processed by the payment provider selected at checkout and is subject to that provider’s terms.

Promotions, coupons, wholesale pricing, teacher pricing, and other discounts may have separate eligibility rules, expiration dates, exclusions, and quantity limits. Unless expressly stated, offers may not be combined or applied retroactively.

5. Shipping and delivery

Our current processing schedule, carrier information, and related expectations are described in the Shipping and Processing Policy. Delivery dates are estimates, not guarantees, unless we expressly agree otherwise in writing. When an order cannot ship within the stated or legally required time, we will provide any notice, cancellation option, consent request, or refund required by applicable law. Please inspect your shipping address before submitting an order and contact us promptly if a correction is needed.

6. International orders

International customers are responsible for confirming that products may lawfully be imported into the destination country. Customs duties, value-added tax, brokerage charges, import fees, and similar charges are not included unless checkout expressly says otherwise. The recipient is responsible for those charges. Refused or undeliverable international shipments may incur carrier return charges as described in our International Orders and Customs Fees Policy. International returns are not accepted under the current Returns and Restocking Policy, except where applicable law requires otherwise.

7. Returns, exchanges, refunds, and damaged items

Return eligibility, required packaging, exchanges, damaged or defective products, restocking fees, authorization steps, and international restrictions are governed by the Returns and Restocking Policy in effect when you place your order. Approved refunds are issued to the original payment method when reasonably possible. Shipping and other nonrefundable charges are excluded unless the policy or applicable law provides otherwise. Nothing in these Terms limits a remedy that cannot legally be limited.

8. Digital products and licenses

Unless a product page says otherwise, purchased downloads and digital content are licensed—not sold—to you for personal, noncommercial use. You may not share access credentials, redistribute, resell, publicly perform, upload, copy in bulk, remove rights notices from, or create commercial derivatives of digital content without written permission. Access may depend on a compatible device, internet connection, account, or third-party platform. Digital-product refunds and cancellation rights are subject to the product listing, applicable law, and any specific terms presented before purchase.

9. Online classes, events, and concerts

Registrations, course materials, attendance, recordings, instructor access, cancellations, transfers, and refunds may be subject to the Online Courses, Events, and Concerts Terms and the applicable listing. Schedules, presenters, formats, and availability may change when reasonably necessary. Educational participation does not create a healthcare-provider, therapist-client, employment, agency, certification, or professional-license relationship unless a separate written agreement expressly says otherwise.

10. Gift cards, promotional credit, and store credit

Gift cards and store credit may be used only through eligible BioSonics sales channels and are not redeemable for cash except where required by law. They may not be resold, used for unlawful payment activity, or combined in a way the checkout does not support. Promotional credit may have additional restrictions or expiration dates disclosed when issued. Contact us promptly about suspected unauthorized use; replacement of lost, stolen, or misdirected codes is not guaranteed unless required by law.

11. Accounts and security

You are responsible for protecting your password, account, devices, and login links and for activity conducted through your account. Notify us promptly of suspected unauthorized access. You may not impersonate another person, create accounts using false information, transfer an account without permission, or attempt to access another user’s information. We may require verification, restrict access, or suspend an account to protect customers, BioSonics, or the Services.

12. Wholesale, teacher, and affiliate programs

Wholesale, teacher, practitioner, and affiliate access requires approval and may be governed by separate program terms. Eligibility, pricing, resale restrictions, tax documentation, territories, commissions, disclosures, brand use, and termination rules may differ from ordinary retail terms. Affiliate and compensated endorsements must clearly disclose the material relationship in accordance with applicable law and program requirements. Approval is personal to the approved account and may be reviewed or withdrawn under the applicable program terms.

13. Intellectual property

The Services and their text, designs, photographs, video, audio, downloads, course materials, product names, logos, software, data, and arrangement are owned by or licensed to BioSonics and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for their intended personal or internal business purpose. No other right is granted. You may not reproduce, scrape, republish, sell, frame, mirror, reverse engineer, or commercially exploit protected content without prior written permission or another legal right.

14. Reviews, feedback, and other submissions

You retain ownership of content you submit. By submitting a review, photograph, testimonial, feedback, or other content through the Services, you grant BioSonics a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute it as reasonably needed to operate, improve, and promote the Services, subject to our Privacy Policy and applicable law. You represent that you have the necessary rights and that your submission is truthful, based on genuine experience where applicable, and does not violate law or another person’s rights. We may moderate or remove content, but we are not obligated to publish or monitor every submission.

15. Acceptable use

You may not use the Services to violate law or rights; transmit malware or harmful code; interfere with security or operation; probe or access systems without authorization; harvest personal information; automate purchases or scraping in a manner that burdens the Services; evade purchase limits or access controls; commit fraud; send spam; impersonate others; or upload unlawful, deceptive, infringing, defamatory, threatening, or abusive material. We may take reasonable steps to investigate and prevent misuse.

16. Third-party services and links

The Services may rely on or link to payment processors, carriers, hosting providers, media platforms, analytics providers, social networks, and other third parties. Their services and websites are governed by their own terms and privacy practices. BioSonics does not control third-party availability, content, or conduct and is not responsible for them except to the extent applicable law provides otherwise.

17. Privacy and electronic communications

Our Privacy Policy explains how personal information is handled. By using the Services, you consent to receive transactional communications electronically, including order, account, security, policy, and service notices. You may unsubscribe from marketing messages using the method provided in the message, but you may still receive nonmarketing communications needed to operate your account or fulfill a transaction.

18. Disclaimers

To the fullest extent permitted by applicable law, the Services and site content are provided “as is” and “as available.” BioSonics disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement, except for warranties that cannot be disclaimed or any express written product warranty we provide. We do not promise uninterrupted or error-free access, that all content will always be current, or that any product, frequency, class, technique, or wellness practice will produce a particular outcome.

19. Limitation of liability

To the fullest extent permitted by applicable law, BioSonics and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, revenue, data, goodwill, or opportunity; or damages arising from third-party services, even if advised that such damages are possible. To the extent liability cannot be excluded, BioSonics’ aggregate liability arising from a purchase will not exceed the amount you paid BioSonics for the product or service giving rise to the claim during the twelve months before the event. These limitations do not apply where prohibited or to liability that cannot legally be limited.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BioSonics and its officers, employees, contractors, and affiliates from third-party claims, damages, and reasonable costs arising from your unlawful use of the Services, your content, or your material breach of these Terms. This obligation does not apply to the extent a claim results from BioSonics’ own unlawful conduct.

21. Consumer rights and local law

You may have mandatory rights under the consumer laws of your state, province, country, or territory. Nothing in these Terms excludes, restricts, or modifies a guarantee, warranty, remedy, or liability that cannot lawfully be excluded, restricted, or modified. If a provision conflicts with a mandatory legal right, the mandatory right controls only to the extent of the conflict.

22. Changes, suspension, and termination

We may update the Services and these Terms as our products, operations, or legal obligations change. The “Last updated” date identifies the current version. Material changes will receive notice when required by law. Changes apply prospectively from their effective date. We may suspend or terminate access when reasonably necessary for security, maintenance, legal compliance, discontinued services, or a material breach. Provisions that by their nature should survive termination—including payment, license restrictions, intellectual property, disclaimers, liability limits, and indemnification—will survive.

23. General terms

If part of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a reorganization, merger, sale, or transfer of the applicable business, subject to applicable law. These Terms, together with incorporated policies and any applicable product- or program-specific terms, are the entire agreement regarding the Services they cover and supersede prior statements on that subject.

Before starting a formal dispute, please contact customer service and provide enough information for us to try to resolve the issue. Applicable law governs any rights or remedies not addressed in these Terms. Any governing-law, venue, or dispute-resolution provision in a separate written agreement remains applicable to that agreement.
